If you’re thinking about buying HTC’s new flagship Android phone the main one X or even the brand new EVO 4G LTE for Sprint, you could be waiting some time.

Shipments of both phones has been delayed in U.S. customs due to a “review of shipments that's needed is after an ITC exclusion order.”

The ITC exclusion order involved dates back to a year ago when HTC was charged with violating 10 Apple patents. A judge ruled in favor of Apple on two of those claims, and inherited a limited exclusion order at the conclusion of last year prohibiting devices that infringed about the patent from being imported into the U.S.

The patent infringement under consideration in this case is giving users the opportunity to click on a phone number on a webpage or email to call that number. Within an official statement HTC acknowledged the issue and indicated it really is working with customs officials on having the handsets in shops.

“We believe we are in compliance with all the ruling and HTC is working closely with customs to secure approval. HTC One X and HTC EVO 4G LTE have both received enthusiastic support so we appreciate customers patience once we work to get these items into their hands at the earliest opportunity.”

While the court ruling reduced last year, it only started being enforced on April 19 -- the idea being that the court was giving HTC time for you to comply with your order. Even if the phones are in compliance with all the ITC ruling they would still need to be inspected before they may be sold.

The HTC One X was launched on May 6 on AT&T and it is currently called “out of stock” of AT&T’s website.

The EVO 4G LTE was expected to be released on Sprint on May 18. While Sprint has acknowledged how the phone is delayed it's got not, however, given a date that customers who order the phone -- or those just considering buying it - will get the device.

Delivery of pre-ordered phones take presctiption hold. U.S. customers who don’t want to wait can cancel their existing order by calling 866-789-8292.
